Peak Auctions Terms and Conditions

1. Payment and Pickup: All winning bidders must pay in full within 24 hours of the auction’s close unless otherwise stated. Items must be picked up within 3 days of payment at the designated time and location. Failure to pay or pick up on time will result in forfeiture of the items and any payments made, at Peak Auctions’ discretion. No refunds will be issued for forfeited items.
2. Buyer Responsibility: Buyers are responsible for inspecting items prior to bidding. All items are sold “as-is, where-is” with no warranties, expressed or implied, by Peak Auctions. We are not liable for damage to sealed items, items damaged during shipping, or any defects not disclosed. Bidding is a contractual agreement between (you) the bidder and (Peak Auctions LTD.) the auctioneer you agree to this when placing a bid, these terms and conditions are non-disputable.
3. Forfeiture: If a buyer fails to pay, pick up items on time, or otherwise breaches these terms, Peak Auctions reserves the right to cancel the sale, retain any payments as liquidated damages, and re-auction the items without further notice.
4. Liability: Peak Auctions is not responsible for any loss, damage, or injury arising from the use, transport, or condition of auctioned items. Buyers assume all risk upon winning a bid.
5. Disputes: All sales are final. Any disputes will be resolved at Peak Auctions’ sole discretion.
6. Intellectual Property: Peak Auctions photographs each item using its own images with lot numbers, that when searched via the web comes back to Peak Auctions, which are considered the company's intellectual property, This becomes a liability issue for Peak Auctions when bidders pose photos as their own. Any bidder found using Peak Auctions' intellectual property without permission - such as using our lot photos for the purpose of reselling on marketplace - will be permanetly banned from participating in future auctions. This policy is non-negotiable, and offending bidders will be required to remove any such listings immediately. Unauthorized use of our intellectual property may also result in legal actions to protect our rights under applicable copyright and intellectual property laws.
